Terms & Conditions

Upon placing an order we will send you an email confirming receipt of the order and details of such. Please note that this does not mean your order has been accepted.

Your order will only be accepted by us when we confirm the goods are available and that we can arrange delivery, at this point the Contract between us will be made.

All information on this website constitute as an “invitation to treat” and is not a contractual offer which you can accept. Monton Fencing Ltd reserves the right to cancel any orders or correct prices and/or quantities which may be incorrect.

Full payment must be received prior to the delivery of any materials being made. All products remain the property of Monton Fencing Ltd until full payment has been received.

Prices on the website may differ to prices in store.

All prices are inclusive of VAT unless otherwise stated.

All prices and products are subject to change without prior notice.

We reserve the right to cancel the contract between us should there be insufficient stock available to deliver the goods which have been ordered. In these cases we will inform you as soon as possible and refund any monies due within 30 days.

It is accepted that you as the consumer have not relied on any statement, advise or representation made by Monton Fencing Ltd in relation to the estimate of quantities, suitability of goods or measurements provided by ourselves (based on your information). Any information in this respect provided by Monton Fencing Ltd is given as guidance only and without liability.

Please note that timber products are subject to swelling, shrinkage, twisting and general distortion due to weather conditions which are beyond our control. We do not accept returns, exchanges or provide refunds for products that are deemed not acceptable for the reasons listed above.

We do not advise to paint any treated timber product within the first 12 months of purchase as they are still absorbing the treatment from the manufacturing process. Painting products too early can cause excessive swelling and/or shrinkage and could lead to damage of the product. We do not accept any liability for products that are painted beyond the point of purchase and no refund or exchange will be provided for such.

No allowance is made by Monton Fencing Ltd for wastage, installation or additional materials ordered which may be surplus to requirements.

No refunds or returns are accepted on made to measure items (gates, fencing, concrete products), we rely on your measurements to manufacture and cannot be held liable for any mistakes or errors.

Any cuts, made to order panels or gates must be collected or a suitable date arranged for delivery by the customer within 4 weeks of manufacture. Should the products not be collected or delivered within this period then the products will be destroyed with no refund being made available to the customer.

On cut items or made to order items please note that we do not provide the off-cuts or waste component parts as part of your order.

Monton Fencing Ltd will not be held responsible for any errors in pricing due to software malfunction or errors due to human error. We reserve the right to cancel or decline any bulk or high value purchases. This is inclusive of Covid-19 or any variant arising from such.

Monton Fencing Ltd will not be liable for any loss of profits, administrative, inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. Refused delivery orders marked returned for no fault of Monton Fencing Ltd does not relieve the purchaser liability for paying any carriage and restocking charges incurred in the return of the goods to Monton Fencing Ltd.

This does not affect you statuary rights as a consumer. As you have the right to cancel the order we also have the right to refuse sales order largely but not exclusively due to the following reasons:

1. The goods ordered are no longer available.

2. A pricing error occurred though our sales staff or web site

3. Authorisation for your payment was declined

If any of the above or indeed other situations result in a cancelled order prior to despatch and assuring payment has been taken for the goods then we will refund any money taken for the order and notify you with our reason for cancellation and in order to offer you a suitable alternative.

We have the right to revise and amend these terms and conditions from time to time as the business see fit.

Monton Fencing Ltd shall not be liable for any failure to perform, or delay in performing, any of its obligations under the contract if and to the extent that the failure or delay is caused by circumstances beyond our control.

This is inclusive of any issues caused by Covid-19 or any variant arising from such which would stop us fulfilling our obligations to you as the consumer.
